1. Company Identification and Scope

These Terms and Conditions govern the use of the Cacto Studio website and the purchase of products presented in our e-commerce. Cacto Studio is a brand headquartered in Girona, Spain, dedicated to the design and in-house production of exclusive decorations for events and celebrations. By browsing the shop or placing an order, you fully accept these conditions.

 

2. Products and Availability

Cacto Studio specialises in the design and in-house production of exclusive decorations for events and festive occasions.

  • The images published on the website aim to represent the products as faithfully as possible. However, minor variations in colour perception may occur depending on each screen’s settings.

  • All orders are subject to the availability of materials at our workshop. In the event of a stock shortage, we will contact you immediately to propose an alternative or arrange a full refund of the amount paid.

 

3. Prices and Payment

The prices displayed on the website are in Euros and include the applicable VAT in accordance with current tax regulations. Shipping costs are not included in the product price and will be calculated and displayed before checkout, in your Bag.

We offer 100% secure payment methods with full encryption of banking data. After payment confirmation, you will receive an order confirmation email with all the details of your purchase.

 

4. Shipping and Delivery

We ship across Europe from our workshop in Girona, Spain.

  • Estimated delivery times are shown at the time of purchase and vary depending on the carrier selected and the destination country.

  • Cacto Studio is not responsible for delays caused by external factors beyond our control, such as transport strikes, customs disruptions, or force majeure situations. We do, however, commit to providing personalised follow-up to help resolve any issues.

 

5. Right of Withdrawal (Returns)

In accordance with European e-commerce legislation (Directive 2011/83/EU), the customer has the right to withdraw from the purchase contract within 14 calendar days from the date of receipt of the order, without the need to provide justification.

  • The product must be returned in its original packaging, in perfect condition, and without signs of use. Return shipping costs are the buyer’s responsibility.

  • Important exception: The right of withdrawal does not apply to personalised products or items made to measure according to the customer’s direct instructions, as per Article 16 of Directive 2011/83/EU, since these items cannot be resold.

 

6. Dispute Resolution

In the event of a dispute, the parties commit to seeking an amicable solution through our customer support service as a first step. Additionally, the customer may use the European Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr.

 

7. Intellectual Property

All designs, photographs, texts, logos, and concepts presented on Cacto Studio are the exclusive property of our brand and are protected by applicable intellectual property laws. Any reproduction, copying, or commercial use of this content is expressly prohibited without prior written authorisation from Cacto Studio.

 

8. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the directives and regulations of the European Union and applicable Spanish legislation. In the event of a dispute that cannot be resolved amicably, the parties submit to the jurisdiction of the Courts of Girona, Spain, without prejudice to the consumer’s right to bring proceedings before the courts of their habitual place of residence, in accordance with European consumer protection legislation.
